Do My New Windows Need a Permit?

It depends on the type of window replacement. Generally, insert window replacement does not require permits since it keeps the same window frame. This means the windows will be kept the same size, and will be as structurally sound as the original. If the window frame needs to be replaced, it is very likely that you will need a permit.

Why Do I Need a Permit?

There are legitimate reasons why new windows, and by extension sliding patio doors, require permits. Here are some of these reasons.

  1. Safety — Certain areas of the house, such as windows near doors, the floor, or bathroom, need to have tempered glass. In the event of window breakage, tempered glass shatters instead of forming shards that can lead to injuries.

  2. Egress — Windows in bedrooms and basements have minimum sizes, since they act as a means of escape during an emergency.

  3. Local Requirements — Your home could be located in a neighborhood where homes need to meet certain aesthetic requirements, such as traditional window styles and color palettes.

What Will Happen If the Windows Were Installed Without a Permit?

You have to question your contractor’s legitimacy if they went ahead with the installation despite the lack of permit. Legitimate contractors would not allow installations without a permit as this could cost them their license. If the installation is found to be not up to code, it could get torn down and reinstalled, either at the contractor’s expense or yours.

Do I Need to Apply for Permits Myself?

The good news is contractors are the ones who file for a building permit, so you don’t have to take a day off from work just to apply for a permit. Your contractor may need to pay for some fees. Ask your contractor if it can be added to your bill.
